In 1994, California became one of the few states in the U.S. to enact the three strike law. In an attempt to reduce crime, this law was designed to harshly penalize repeat offenders. Each time a person is convicted of a felony, he or she receives a “strike” on their record and each additional strike adds to the individual’s sentence. For example, a second strike will increase a convicted person’s punishment by adding years to the sentence, perhaps even doubling the prison term. If a person is convicted of a crime resulting in a third strike, that person will be sentenced to a term of 25 years to life. This law is detrimental to the freedom of people who do not deserve such harsh punishments. In fact, by 1996, only 2 years after the 3 strike law was passed, over 1,400 people received life sentences in California.

Some violent crimes which may count as a strike on your criminal record include:

  • Arson
  • Attempted murder
  • Carjacking with a weapon
  • First degree robbery
  • Kidnapping
  • Lewd act on a child
  • Murder
  • Rape
  • Voluntary manslaughter

Many third strike offenders who receive life sentences are not violent offenders at all, but have been convicted for crimes such as petty theft or drug possession. For this, they are to spend the rest of their lives in prison.
